The Biden admin released what they called a clarification in April 2023 called “How to Avoid Immigration-Related Discrimination when Complying with U.S. Export Control Laws.” <\/div>\n

Until now, the U.S. government was pretty clear that you were only supposed to hire U.S. citizens and green card holders… <\/div>\n

They now have this crazy idea that these national security companies should be hiring more refugees and asylum seekers even though this is the definition of a national security risk…<\/div>\n

The key here is that this was only issued in April 2023, but what they’ve done with this lawsuit is go back and say from 2008 to 2022 that SpaceX is retroactively governed by this new understanding…<\/div>\n

What they are saying is that anybody who was screened out as part of this process is entitled to backpay and lost wages since they were screened out. <\/div>\n
<\/div>\n
In other words, it assumes that every single one of those people would have been hired by SpaceX, which is absurd because the bar for hiring at SpaceX is incredibly high.<\/div>\n

And, if they could have got a job at SpaceX, they probably didn’t have any damages because they could probably get a job at 10 other companies as well.”<\/div>\n
